PROBLEMATIKA PERNIKAHAN BAWAH TANGAN DI INDONESIA (Nikah Tidak Dicatatkan)

Abstract

This research is motivated by traditional marriage which is done without knowledge PPN and KUA and siri marriage done by the community and not recorded by PPN and KUA. The problem is legal protection for citizens Indonesia. who only perform traditional marriages or siri marriage. And the legal consequences of unregistered marriage in PPN and KUA as well as Marriage registration in efforts realize the goal maslahat that exists in humans. This research uses an approach qualitative with library research. The research results show that traditional marriage and siri marriage do not receive legal protection and legal consequences that arise is the vulnerability of marriage the process of resolving unresolved children and inheritance and Position of recording of marriage is as an administrative condition in the regulations of law
